{"id":14912,"date":"2021-06-17T15:28:52","date_gmt":"2021-06-17T19:28:52","guid":{"rendered":"https:\/\/orionscoldfire.com\/?p=14912"},"modified":"2021-06-17T15:28:52","modified_gmt":"2021-06-17T19:28:52","slug":"supreme-court-upholds-religious-freedom-in-case-pitting-catholic-adoption-and-homosexual-rights","status":"publish","type":"post","link":"https:\/\/orionscoldfire.com\/index.php\/2021\/06\/17\/supreme-court-upholds-religious-freedom-in-case-pitting-catholic-adoption-and-homosexual-rights\/","title":{"rendered":"Supreme Court Upholds Religious Freedom in Case Pitting Catholic Adoption and Homosexual Rights"},"content":{"rendered":"<p>Within a narrow interpretation <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court-catholic-foster-care-gay-marriage\" target=\"_blank\" rel=\"noopener\">the Supreme Court upheld the right of religious organizations to refuse to allow homosexuals to adopt or foster children<\/a>.\u00a0 The decision was unopposed but was narrowly worded to let stand underlying law that still threatens the 1st Amendment rights of religious freedom.<\/p>\n<p><strong>&#8220;Although Roberts handed a win to Catholic Social Services, he slapped down a push from fellow conservatives to use the case to overturn <i>Employment Division v. Smith<\/i>, a landmark 1990 case in which the court found that laws that are generally applicable do not violate the First Amendment. That decision has been increasingly called into question as a number of states pass laws raising conflicts between religious and gay rights interests. Roberts wrote that\u00a0<i>Smith<\/i>\u00a0did not apply here because Philadelphia&#8217;s policy was not neutral.<\/strong><\/p>\n<p><strong>Several justices said they wanted to revisit\u00a0<i>Smith<\/i>. In her concurrence, Barrett wrote that she had found &#8220;compelling&#8221; reasons to overturn\u00a0<i>Smith<\/i>. Still, she added, that since the case did not apply here, she joined the court&#8217;s opinion in full.
