I read the Alito opinion.\u00a0 I listened in the news to the fears of the Left about future decisions on other unconstitutional decisions.\u00a0 And I think they may have a good reason to be afraid.\u00a0 If this court was willing to overturn Roe v. Wade, then there isn\u2019t any additional justification needed to overturn other unconstitutional laws.<\/p>\n
The lack of constitutional grounds to declare gay marriage a national right is exactly the same as the problem with making abortion a right.\u00a0 And some things are even easier to attack.\u00a0 Affirmative action is actually prohibited by a constitutional amendment.\u00a0 It was even acknowledged to be unconstitutional the last time it was allowed to stand by the Supreme Court.\u00a0 Each of these examples of judicial malpractice can be addressed in exactly the same way as Roe v. Wade.\u00a0 The question is will these justices continue to display the courage they seem to have right now?<\/p>\n
I think they will.\u00a0 And I think we\u2019ll have the answer to the question in July.\u00a0 That\u2019s when the decision on Roe v. Wade is supposed to be announced.\u00a0 If the five justices manage to stand up to the barrage of intimidation and character assassination that they are currently receiving then I think they\u2019ll be hardened enough to move forward to other areas of the law where equally unconstitutional decisions have been made before.<\/p>\n
I find this possibility exhilarating.\u00a0 For my whole adult life, I have watched the Supreme Court create unjust laws and then fail to reverse those decisions when the chance to do so arose.\u00a0 Justices named by Reagan, George Bush Sr. and George Bush Jr. were touted as conservatives and almost invariably turned out to be liberals.\u00a0 But now, so many years later it looks like we\u2019re there.\u00a0 And half the thanks have to go to Mitch McConnell and Donald Trump, two men who cannot stand each other.\u00a0 I find that highly ironic.\u00a0 But I won\u2019t look this gift horse in the mouth.\u00a0 It\u2019s too valuable.<\/p>\n
Now, I\u2019m fully aware that more than half of you are rolling your eyes and thinking, \u201cWhat a hopeless optimist!\u201d\u00a0 And I can\u2019t blame you.\u00a0 We\u2019ve been down this road so many times before that it\u2019s completely understandable that most folks don\u2019t want to get fooled again.\u00a0 It\u2019s just like that cartoon of Lucy pulling the football away from Charlie Brown just as he\u2019s ready to kick it.\u00a0 And ends up flat on his back.\u00a0 For the last year I\u2019ve been very doubtful that the Supreme Court would go all the way and overturn Roe altogether.\u00a0 I figured they\u2019d approve the fifteen-week limit in Mississippi and leave it at that.\u00a0 But apparently, they\u2019ve gotten together the backbone to admit the truth of the situation and make an honest ruling.\u00a0 And that\u2019s amazing.<\/p>\n
So, if in July they back down and issue a watered-down decision I\u2019ll openly admit my foolishness.\u00a0 I\u2019ll admit that we can\u2019t \u201cvote our way out of this.\u201d\u00a0 But if I\u2019m right then I\u2019ll expect the same admission from the skeptics and dissidents that say there\u2019s no hope of turning things around.\u00a0 And you know who you are out there.<\/p>\n","protected":false},"excerpt":{"rendered":"
